1Agreement to these terms

By creating an account, connecting your X account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other organization, you confirm that you have authority to bind it, and “you” includes that organization.

2What the Service is

Twit Dragon is an AI-assisted writing and publishing tool for X. It helps you draft posts and replies, review, edit and approve them in a queue, optionally schedule them, and publish them to your connected X account. Optional features include a voice profile that learns from your own posts, a watchlist that suggests replies to public posts, and credits that meter AI usage.

Twit Dragon is independent of X. It is not affiliated with, endorsed by, or sponsored by X Corp.

We may add, change, limit or remove features at any time, including usage limits such as daily reply caps, quiet hours and credit costs, to keep accounts safe, to follow X’s rules, or for business reasons. We do not promise that the Service will be uninterrupted or error-free.

3Eligibility and your account

  • You must be at least 18 years old and able to form a binding contract.
  • Give us accurate information and keep it up to date.
  • You are responsible for everything that happens under your account and for keeping your credentials secure. Tell us promptly at support@twitdragon.com if you suspect unauthorized use.
  • An account is for one person. Do not share it, sell access to it, or let others use it.
  • If you sign in with Google or GitHub, that provider’s terms also apply to your sign-in.

4Connecting X and permission to act for you

Your authorization

When you connect X, you authorize Twit Dragon to act on your behalf with the permissions you approve on X’s consent screen: reading posts and profile information, publishing posts and replies, and staying connected until you revoke access. We publish only content you have approved in the app, or content produced by an automation feature you have expressly turned on (for example, auto-approved scheduled posts). We never ask for your X password.

You can disconnect X under Settings → X Account or revoke access at x.com/settings/connected_apps. Revoking access stops publishing.

Your responsibilities

You confirm that you own, or are authorized to use, the X account you connect. Your use of X through the Service must comply with X’s Terms of Service, X Rules, Automation Rules and any other policies that apply to you. If you enable features that publish automatically, you are responsible for meeting any labeling or disclosure rules X applies to automated accounts.

X controls its platform

X may change, limit, price, suspend or condition API access, including for AI-assisted replies. We may change or restrict features in response, for example by requiring you to post certain replies yourself on X instead of publishing them automatically. We are not responsible for X’s decisions, including any restriction or suspension of your account, or any loss of reach or engagement.

5AI-generated content and your responsibility

Drafts and replies (“Output”) are produced by AI models. Output can be inaccurate, incomplete, outdated, biased, offensive, or similar to content generated for others, and it may rely on web search results that are themselves wrong. It is a starting point, not advice.

  • You review everything. You decide what to approve and publish, and you are the author and publisher of what appears on your X account.
  • You are responsible for what you post, including its accuracy and legality, third-party rights, advertising and endorsement disclosures, any law that requires disclosing AI-generated content, and X’s policies.
  • Do not rely on Output for legal, medical, financial or other professional advice, or for decisions that significantly affect people.
  • The voice profile is meant to reflect your own writing. Do not use it to imitate or impersonate anyone else.

6Your content, Output and our license

Your content

You keep ownership of the content you provide, including your themes, instructions, posts you share with the voice profile, and your edits (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit and display Your Content, and to create Output from it, solely to provide, secure, support and improve the Service as described in these Terms and our Privacy Policy, including by sending it to our AI providers and to X at your direction. This license ends when Your Content is deleted, except for backups and records we must keep.

Output

As between you and us, and to the extent the law allows, you own the Output you approve and use, and we assign to you any rights we have in it. We do not promise that Output is protectable by copyright or unique; the same or similar Output may be generated for other people.

No training on your content

We do not use Your Content or Output to train AI models. We may use de-identified, aggregated usage information to operate and improve the Service.

X content

Posts and data from X belong to their owners and stay subject to X’s terms. Use them only within the Service. Do not extract, redistribute them, or use them to train models.

Feedback

If you send us ideas or suggestions, we may use them freely without obligation to you.

7Acceptable use

You agree not to, and not to let anyone else:

  • break the law, or use the Service to create or publish content that is unlawful, defamatory, harassing, hateful, threatening or sexually exploitative, or that infringes or violates the rights or privacy of others;
  • violate X’s Terms of Service, Rules, Automation Rules or Developer Policy, including spam and platform manipulation, bulk or aggressive following, posting identical or near-identical content across accounts, sending unsolicited automated replies or mentions, buying or selling engagement, or evading rate limits or suspensions;
  • mislead people about who or what is posting, or impersonate any person or organization;
  • use the Service to infer sensitive characteristics about people (such as health, politics, religion, ethnicity or sexual orientation), to surveil, profile or track individuals, or to harass or target a person;
  • bypass or disable the approval step, usage limits, credit metering, quiet hours or other safeguards, or use the Service to send automated replies where X’s rules do not allow them;
  • misuse free trials or promotions, for example by creating multiple accounts or using another person’s identity to obtain repeat trials or credits;
  • scrape or extract the Service or X content from it at scale, resell the Service, or use it to build a competing product or to train or benchmark AI models;
  • probe, test or reverse engineer the Service, interfere with its operation or security, upload malware, or access it by automated means other than the interfaces we provide; or
  • use the Service in a way that could harm X, our providers, other users, or us.

We may investigate suspected violations and may remove content, limit features, or suspend or terminate accounts.

8Plans, credits, billing and free trials

Plans and credits

Paid plans and optional credit packs are described, with prices and included credits, on our pricing page and at checkout. A paid subscription, or complimentary access we grant, is required to use the app.

  • Credits meter AI actions. The cost of each action is shown in the app and on the pricing page and may change going forward. Credits are deducted when a generation completes.
  • Monthly credits come with your plan, replace (rather than add to) the previous balance at each renewal, and expire at the end of each billing period.
  • Credit packs are bought separately, are used after your monthly credits, and do not expire while your account remains open.
  • Credits have no cash value, cannot be transferred, and are forfeited when your account closes, except where the law requires otherwise.

Free trials

Where we offer one, a free trial of a paid plan lasts 14 days. You provide a payment method to start it. Unless you cancel before the trial ends, the subscription converts automatically to the paid plan and we charge the price shown at checkout. Trial credits are a one-time allotment. Each person may use one trial: we check the email and the connected X account, and may refuse or end a trial that appears to be repeated or abused.

Automatic renewal and cancellation

  • Paid subscriptions renew automatically at the end of each billing period (monthly or annual, as you chose) at the then-current price for your plan, until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method at each renewal.
  • Cancel any time under Settings → Billing (which opens the Stripe customer portal), or by emailing support@twitdragon.com. Cancellation takes effect at the end of the current billing period, or of your trial, so you keep access until then and are not charged again.
  • Where the law requires, we will remind you before an annual renewal or before a trial converts to a paid plan.

Payment, taxes and failed payments

Prices are in US dollars unless stated and exclude taxes, which we or Stripe may calculate and collect as the law requires. You must give us accurate billing information. If a payment fails, we may retry it, notify you, and suspend or limit access, credit grants or features until it is paid. If you have a billing problem, please contact us before disputing a charge with your bank.

Refunds

Except where the law requires or these Terms state otherwise, payments are non-refundable, and we do not refund partial billing periods or unused credits. If you believe you were charged in error, or you could not use the Service because of a fault on our side, contact support@twitdragon.com within 30 days and we will review it in good faith. A refunded credit pack may be deducted from your balance.

Changes to prices and plans

We may change prices, plans, included credits or credit costs. For existing subscribers we will give at least 30 days’ notice by email or in the app before a change takes effect at your next renewal, and you can cancel before then. Credit-pack prices may change at any time for future purchases.

Promotions and complimentary access

We may offer promotion codes, discounts or complimentary plans at our discretion. They are non-transferable, have no cash value, remain subject to these Terms and any conditions we state, and may be limited, changed or ended by us, including by canceling the related subscription on notice. Complimentary access has no guaranteed duration.

Right of withdrawal (EU and UK consumers)

If you are a consumer in the EU or UK, you may have a right to withdraw within 14 days of buying a subscription or credit pack. By asking us to start the Service or use credits during that period, you request immediate performance and acknowledge that you may lose the right once the service has been fully provided, and that you may owe a proportionate amount for what you have used.

9Third-party services

The Service depends on services we do not control, including X, Stripe, Google and GitHub sign-in, and AI providers. Their terms and policies govern your use of them. We are not responsible for their availability, changes, fees or actions, including X rate-limiting, repricing or suspending API access, or restricting your account. If a third-party service becomes unavailable or changes its terms, we may modify or discontinue affected features.

10Our intellectual property

We and our licensors own the Service, including its software, design, text and graphics, and the Twit Dragon name and logo. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own purposes. X and other third-party names and marks belong to their owners, and nothing here implies their endorsement.

11Privacy

Our Privacy Policy explains how we handle personal information. Please do not submit content you do not have the right to share, or sensitive personal information, which the Service is not designed to protect.

12Suspension and termination

You can stop using the Service at any time by canceling your subscription and deleting your account. If you have an active subscription, cancel it before you delete your account so that billing stops.

We may suspend or end your access immediately, with notice where practical, if you breach these Terms, the law or X’s policies, if your use creates risk or could harm our access to X or our providers, if you do not pay, or if we stop offering the Service (in which case we will refund the unused part of any prepaid period).

When access ends, your license to use the Service ends, we handle your data as described in the Privacy Policy, and unused credits are forfeited. Provisions that by their nature should survive will survive, including sections on content, payment obligations, intellectual property, disclaimers, liability, indemnity and disputes.

13Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE; THAT OUTPUT WILL BE ACCURATE, ORIGINAL OR SUITABLE FOR YOUR PURPOSE; THAT USING THE SERVICE WILL INCREASE YOUR FOLLOWERS, REACH OR ENGAGEMENT; OR THAT YOUR X ACCOUNT WILL NOT BE RESTRICTED OR SUSPENDED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, REPUTATION OR AUDIENCE, OR FOR ANY RESTRICTION OR SUSPENSION OF YOUR X ACCOUNT, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY; AND
  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US$100.

These limits do not apply to liability that cannot be limited by law, such as for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence, and they do not affect consumer rights that cannot be waived where you live.

15Indemnification

You will defend, indemnify and hold harmless 12TH LAB LLC and its owners, contractors and agents from third-party claims, and related damages, liabilities, costs and expenses (including reasonable attorneys’ fees), arising from content you publish through the Service, your use of the Service in violation of these Terms, the law or X’s rules, or your infringement of anyone’s rights. We will tell you promptly about any claim, and you may control its defense but may not settle it in a way that admits fault on our behalf without our consent. This section does not apply where the law prohibits it.

16Governing law and disputes

These Terms, and any dispute arising from them or the Service, are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and by applicable US federal law.

Before filing a claim, please contact support@twitdragon.com and give us 30 days to try to resolve it informally. If that does not resolve it, you and we agree that the exclusive venue for any claim is the state and federal courts located in New York County, New York, and each consents to personal jurisdiction there.

If you are a consumer outside the United States, you may also bring claims in your home courts, and mandatory consumer-protection laws of your country continue to apply to you.

17Changes to these terms

We may update these Terms. For material changes we will give at least 30 days’ notice by email or in the app before they take effect, except where a shorter period is needed for legal, security or X-policy reasons. If you keep using the Service after the effective date, you accept the updated Terms. If you do not agree, cancel before they take effect.

18General

  • Entire agreement. These Terms, the Privacy Policy, and any pricing or checkout terms shown when you buy are the entire agreement between you and us about the Service.
  • If part is unenforceable, the rest still applies. Our not enforcing a provision is not a waiver of it.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
  • Events beyond our control. We are not liable for delays or failures caused by events outside our reasonable control, including outages of X or other third-party services.
  • Notices. We may give notice by email to your account address or in the app. You may contact us at support@twitdragon.com.
  • Export and sanctions. You may not use the Service if you are barred from receiving it under US or other applicable sanctions or export laws.
